Before you continue using this app, we advice you to read our privacy policy HERE regarding our user data collection. It will help you better understand our practices. Our own produced content does not require our users to be adults, but as some of our content is user generated and users can contact each other, it is adviced that persons younger than 18 are supervised by an adult. By using this app, you warrant that you are at least 18 years of age and you may legally adhere to this Agreement OR that your parents or guardian have read these terms and accept this Agreement on your behalf and accept responsibility for your safety and for your actions when using the app. Digital Aq Assistant AB assumes no responsibility for liabilities related to age misrepresentation. You agree that all materials, products, and services provided in this app are the property of Digital Aq Assistant AB, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents , and other intellectual property. You also agree that you will not reproduce or redistribute our intellectual property in any way, including electronic, digital, or new trademark registrations. You grant us a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content you upload and publish. This is primarily to be able to use your content as you have intended it to be used, but we also reserve the rights to use published content in a way that you may not have been expecting. For example if you upload a great image to your aquarium gallery it could possibly be used royalty-free in an article in the app or if it contains a good image of a species we need better images for, we reserve the rights to use your image in our species description to provide all of our users with as good content as possible. We will of course publish the photographers name in such a case to credit him or her. When you upload an image or video, you are responsible to make sure that you own the rights to it or that you have the owners permission to publish the content and for it to be used according to our terms. If you overstep these boundaries and upload an image that you don’t own or have permission to publish, we reserve the right to banish or delete your account with no refunds and no compensation. For issues regarding intellectual property claims, you should contact the company in order to come to an agreement. For the time being we allow users to use parts of the app anonymously without having to register an account. We reserve the right to change this policy at any time and possibly refuse further use without registration if our policy changes. If you are not registered, you will be muted in the community to prevent spam accounts and other trouble makers from disrupting the communtiy. If you don’t register, you still have an unregistered anonymous account to which everything saved in the app is stored. Anything you save in the app on this account may be deleted or lost and unrecoverable if you lose your unit or in an app update that could trigger an automatic logout from your anonymous account in the app. For security reasons an automatic logout of an anonymous account will take place if you don’t use the app for a year. We highly recommend that you register your account. As a user of this app, you may be asked to register with us and provide private information. You are responsible for ensuring the accuracy of this information, and you are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or password. If you think there are any possible issues regarding the security of your account on the app, inform us immediately so we may address it accordingly. We reserve all rights to terminate accounts, edit or remove content and cancel orders in their sole discretion. For user-friendliness, you will normally remain logged in on the app until you actively log out. For security reasons, you will however automatically be logged out after 30 days of not using the app. In some parts of the app, you have the possibility to publish content. You are responsible for, and if necessary, held accountable for what you publish. You are not allowed to publish anything that is illegal or in any other ways goes against our terms of service. You should not publish any sensitive information about yourself, like your address, phone number or credit card information etc in comment fields or in the forum for example. Everybody have the right to act anonymously under their username in this app so it is strictly prohibited to out someone else's personal information as well. The goal of this app is to spread knowledge and enthusiasm about the aquarium hobby, so if you see someone doing something wrong, don’t blame or insult them, teach them! We have all been beginners and we all want what is best for our pets. We accept no insults, no harassment, no nude pictures, no grooming, no spam, no off-topic posts, no excessive cursing or other bad behaviours. The community is intended for discussions regarding aquarium related topics and nothing else. There should for instance be no reason to discuss politics unless it is strictly related to the hobby, like a new species possibly being regulated or something. All other political content will be considered off-topic and irrelevant and will be handled accordingly. There should also be no reason to discuss religion or other sensitive topics. Everyone has a right to their own beliefs but it is not relevant to the hobby and off limits to discuss here. All posts should be in the specified language for the area. If no other language is specified and there is no possibility to select your language, your post must be in English. We do not allow you to in any way post marketing like ads, commercials or similar content for example in comment fields or in the forum unless we have expressively allowed it. You are allowed to discuss different products or brands and review or recommend them, but we can not allow the forum to just become a big clutter of ads and promotions. If everybody did that it would completely ruin the forum for everyone so use common sense. We reserve the right to judge whether your post is to be considered prohibited marketing or not and what action to take in such occurrences. Attempts of hidden marketing will be considered the worst. If you violate any laws in relation to our app or violate our terms we reserve the rights to censor or delete your content related to the violation or possibly all of it. We also reserve the right to end your subscription, mute you in the community, ban your account for a specified time or permanently and possibly even delete your account without any refunds or compensations. In cases where we are legally required to, we will also share your information with law enforcement if they have the authority to demand that we do so or if we see fit to do so. If you don’t have a subscription, you will have to get used to some ads. These are provided by Google AdMob. When you use the app without a subscription Google AdMob may collect, share and/or use personal data for personalization of ads. In the app settings, you can choose to get non-personalized ads and this should, to the best of our knowledge, prevent personal data from being collected, shared and used. If you have a subscription all adds will be removed and Google AdMob’s service will be closed down. This should also, to the best of our knowledge, prevent them from collecting any user information in the app. There are In-App Purchases available on this app. These are subscriptions to provide an add-free environment and other bonus features in the app. Subscription renewal can be cancelled at any time in the app. If there are any issues regarding a purchased service, please contact us for support. If a new subscription seem to fail to take effect immediately after a successful purchase, please try to restart the app and if that don’t work, logout and login again. If none of this works don’t hesitate to contact us! You acknowledge and agree that you are fully responsible for managing your In-App Purchases. If you are under 18, then you must have your parents’ or guardians’ permission to make any In-App Purchases. By completing an In-App Purchase, you are confirming to us that you have any and all permissions that may be necessary in order to allow you to make that In-App Purchase. All purchases and your credit card information will, for your security, be processed trough the (”App Store Provider”) Google Play or Apple iTunes App Store depending on your unit. You acknowledge and agree that all billing and transaction processes are handled by the App Store Provider from whose platform you downloaded the app and are governed by the App Store Provider’s terms and conditions/EULA. If you have any payment related issues with In-App Purchases then you need to contact the App Store Provider directly. When you cancel a subscription you are canceling the renewal of the subscription. The subscription privileges will remain for the previously purchased subscription time. This means that after the subscription is cancelled there are no more charges to you and there are no refunds because you will get what you payed for until the already purchased subscription expires. If you already have a subscription and upgrade to a more exclusive subscription type, the new privileges will take effect immediately. Then the value of the remaining old subscription will be subtracted from the first charge for the new subscription. The App Store Provider will handle this automatically. In case of serious violations of the terms for using our app and being a part of our community, we reserve the right to mute, permanent ban or delete your account with no refunds or compensation. We make reservations for any printing mistakes or errors in all our campaigns in all of our channels and advertisements! You may only receive a free trial once and only if you have not previously had or currently have a subscription. We work hard to provide you with as good information about different species as we possibly can and we are certainly open to correct any information about any species if there is anything that we have got wrong. We do not take any responsibility for what happens when you follow our recommendations and we encourage everyone to search for as much information as possible about all the species you own or are considering to own. You can always ask the community! We also work hard and take pride in our security work. We use encryption on all communications with the server and extra layers of encryption and protection for sensitive information and we try to store as little sensitive information as possible. However, we do not take any responsibility for any malicious attacks on our services or your unit and the consequences of such an attack. But know that we will always work hard to secure our app, other services and sensitive information and we never store or handle any credit card information (see In-App Purchase). Public posts in forums and comment fields and such are examples of ”information” not being regarded a secret and may as such have fewer security layers to protect it. Private messages to friends or other sensitive information are always encrypted in multiple layers when sent over the internet or if it have to be stored in a database. We reserve the right to modify this app and it’s functions at any time. We also reserve the right to shut down our servers for maintenance and upgrades, unexpected technical interruptions or other unforeseen problems. We will work hard to solve all problems as fast as possible to keep our services up and running. By using this app, you agree that the laws of Sweden, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between Digital Aq Assistant AB and you, or its business parters and associates. Any dispute related in any way to your use of this app or to products you purchase from us shall be arbitrated by a court in Sweden and you consent to exclusive jurisdiction and venue of such courts. You agree to indemnify Digital Aq Assistant AB and its affiliates and hold Digital Aq Assistant AB harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel. Digital Aq Assistant AB is not liable for any damages that may occur to you as a result of your use or misuse of our app. Digital Aq Assistant AB reserves the right to edit, modify, and change this Agreement any time. We shall let our users know of these changes through electronic mail.
